According to reports, China has formulated many single energy laws and regulations, including the Electricity Law, the Coal Law, the Energy Conservation Law, the Renewable Energy Law, and the Urban Gas Management Regulations, but there is still a basic and leading law in the field of energy. The formulation of the Energy Law on the basis of a single energy law and regulations is an important measure to strengthen legislation in key areas and is of great significance to promoting high-quality energy development and ensuring national energy security.

The draft improves the energy development and utilization system, mainly stipulates from six aspects: First, clarify the direction of energy structure adjustment; Second, clarify the energy development and utilization policies; Third, promote clean, efficient, intensive and economical use of energy; Fourth, ensure basic energy supply and services; Fifth, strengthen the construction and protection of energy infrastructure; Sixth, promote rural energy development.

Regarding clarifying the direction of energy structure adjustment, the draft supports priority development of renewable energy, rational development and clean and efficient use of fossil energy, and orderly promote non-fossil energy to replace fossil energy and low-carbon energy to replace high-carbon energy.

In terms of promoting rural energy development, the draft encourages and supports rural energy development, coordinates the construction of urban and rural energy infrastructure and public service systems, and gives priority to ensuring rural daily energy and agricultural production energy consumption when temporary energy supply shortages occur in rural areas.

In order to accelerate the establishment of an energy market system with diversified subjects, unified and open, orderly competition and effective supervision, the draft stipulates that the state promotes the separate operation of natural monopoly and competitive businesses in the energy field; coordinates and promotes the construction of a unified national energy trading market; requires the energy transmission pipeline facilities to be fair and non-discriminatory to those who meet the conditions; encourages coordinated development of upstream and downstream enterprises in the energy field and coordinated promotion of the entire industrial chain; promotes the establishment of an energy price formation mechanism mainly determined by market factors, improves the energy price control system; and promotes international investment and trade cooperation in the energy field.
